Divorce and Child Custody Attorneys in Nebraska
When your family is changing, the decisions made now will shape your finances, your time with your children, and your peace of mind for years to come. At Atwood Law, we bring the same preparation and courtroom experience that built our reputation for injured workers and accident victims to the family law matters that matter most to our clients.
Whether you are considering divorce, trying to protect your relationship with your children, or need an existing order changed or enforced, we will give you a clear picture of where you stand and a plan for moving forward.
How We Approach Family Law
- Your children come first. Nebraska courts decide custody based on a child’s best interests. So do we, when we counsel our clients.
- Prepared for court, open to settlement. Most family cases resolve by agreement, but the best agreements come from being fully ready for trial. We prepare every case as if a judge will decide it.
- Respect for your resources. We will not recommend a costly strategy that will not move your case forward.
- Straight answers. You will know what to expect, what your options are, and what each one is likely to cost in time and money.
How We Can Help
- Divorce in Nebraska – residency, the no-fault process, property and debt division, alimony, and the steps in a typical case.
- Your Divorce Options – agreed, mediated, collaborative, and litigated divorce, and how to choose.
- Collaborative Divorce – a team-based, out-of-court process for spouses who want to resolve things privately.
- Child Custody and Parenting Time – legal and physical custody, parenting plans, and the Nebraska Parenting Act.
- Grandparents and Non-Parents – custody, visitation, and guardianship for the relatives and caregivers raising a child.
- Paternity and Unmarried Parents – establishing parentage, custody, parenting time, and child support.
- Domestic Violence and Protection Orders – seeking protection, or responding if an order has been filed against you.
- Modifications and Enforcement – changing custody, support, or alimony when life changes, and enforcing orders that are not being followed.
Who You Will Work With
Attorney Emily Newcomb Haggstrom represents clients throughout Nebraska in divorce, child custody, paternity, and modification cases. She personally handles her clients’ depositions, hearings, and trials, and she prepares every case as if a judge will decide it.
Through every stage of a case, Emily’s focus stays on what is best for her clients’ children and for her clients as they move forward with their lives. That focus guides her strategy, her negotiations, and her advocacy in the courtroom, from the first meeting to the final order.
That preparation is detailed and deliberate. Emily scripts her depositions question by question rather than working from general topics, so nothing important is left to chance. She builds her cross-examination around the documents themselves, with each prior statement and inconsistency tied to its source. In cases where money is at issue, she reconstructs income and expenses from tax returns, pay records, and financial statements, so the court sees the full picture rather than one party’s version of it. She also prepares her clients carefully for their own testimony, so they know what to expect and can speak with confidence.
Thorough trial preparation is also what makes fair settlements possible. When the other side knows a case is ready for court, negotiations tend to be more productive. Emily is active with the Nebraska Association of Trial Attorneys, where she has presented and organized continuing legal education programs for other lawyers, and she has written for the association’s publication, The Prairie Barrister, on the ethical use of technology in law practice.
