Nebraska man who hit pedestrian has history of fleeing accidents

On Behalf of | Oct 14, 2014 | Car Accidents |

On Sept. 30, a 35-year-old Omaha man was charged for driving with a revoked license and leaving an accident scene without stopping to aid an injured pedestrian. The incident occurred around 7:45 p.m. near Hickory Street and 36th Street when the driver struck a 33-year-old man, who was reportedly thrown 20 feet in the air. Sources say the Omaha man has previously faced charges related to car accidents, including a conviction in 2006.

The injured pedestrian was loading his parked vehicle when he heard the engine of the Chevrolet Blazer and saw it heading towards his vehicle. The man tried to run out of the Chevy Blazer’s path, and the driver allegedly sped away after the collision. Police reports say the driver was booked about two hours later when he called 911 from his home. The man appeared to cooperate with officers and admitted to hitting someone and fleeing. The pedestrian suffered serious injuries, but none were considered life threatening.

According to reports, the driver has received past convictions in 1993 and 1998 for fleeing auto accidents, the latter involving a dismissed DUI charge. He was also sentenced to up to 36 months in prison in 2006 for involvement in a drunk-driving accident that claimed his 30-year-old passenger’s life. In that incident, the man’s BAC level tested at .125 percent, and he admitted to consuming four beers and using marijuana. Officers do not believe substance abuse was a factor in the current accident, but the man was driving illegally using a revoked licensed.

Injured motorists or pedestrians seeking compensation may be able to obtain records of a reckless driver’s past infractions to prove the individual is unfit to drive and acted unlawfully by illegally operating a vehicle. When alcohol, drugs or reckless behavior are involved and lead to fatalities, relatives may file civil claims on behalf of the deceased person to hold distracted drivers accountable financially.

"...He didn't treat me like I was one of 100 clients. He treated me like I was his only client. He acted professionally but with empathy, dignity and friendliness. It didn't matter if it was something small or large, he was always there for me, be it by phone, fax, email, cellphone or meeting me personally at his office or elsewhere. He never rushed me when I didn't understand something, he'd take as much time as needed to explain things to me, especially when it came time for my deposition and in preparation for trial. He was there for me when I truly needed his help..."

He went beyond his role as my lawyer. He even spoke with my bank and explained why I was behind on my car payment. And this saved me getting my car repossessed..."
