Eric S. Haiman has a wide range of experience and a consistent record of success in civil litigation, trials, and appeals. Eric's philosophy is that intelligent and aggressive advocacy is the surest path to victory.

While in law school at the University of California's Boalt Hall, where he also obtained a Ph.D. in law and legal theory, Eric litigated for three years on behalf of children and the disabled with regard to government services. After completing his formal education in 1990, Eric specialized for three years in defending product liability cases involving pharmaceuticals and medical devices and toxic tort cases. During that time, he successfully disposed of numerous cases by way of summary judgment and other motions resulting in dismissal of plaintiffs' cases and successfully defended judgments on appeal. In doing so, he developed several novel and successful legal theories. Eric also developed a computer database of scientific studies and expert testimony for use in nationwide litigation and worked extensively with experts to develop their testimony for trials and to develop materials for cross-examination of plaintiffs' experts. In so doing, Eric created imaginative and persuasive ways to present complex scientific issues to lay jurors. Eric handled and won several trials, including obtaining a defense verdict in a multimillion dollar toxic tort case.

In 1993, Eric joined the firm of Atwood, Haiman & Westerberg where he specializes in commercial and real property litigation. Eric has successfully prosecuted and defended by way of dispositive motions, trial, and appeal dozens of cases in a wide array of commercial and real property matters, including the following:

Escrow liability actions, title insurance bad faith actions, and complex title disputes on behalf of title companies, lenders, and property owners.

Lender liability, secured transactions disputes, complex loan enforcement proceedings, trust litigation, and workouts on behalf of lenders, and contract and business tort actions on behalf of borrowers.

Business disputes, including breach of contract actions, entity dissolution actions, internal business disputes, and general commercial litigation on behalf of small and medium-sized business owners, partnerships, and limited liability companies.

Real property disputes concerning boundaries, easements, encroachments, nuisances, and a wide array of other disputes between owners of real property.

Real property contract disputes.

Commercial and residential landlord-tenant disputes.

Eric has also successfully handled employment discrimination cases for both employers and employees, and provides a full array of advisory, pre-litigation, and litigation services to employers confronted with 'problem' employees.

Eric has a proven record as a litigator, trial attorney, and appellate lawyer.

In addition to his litigation practice, Eric also handles land use matters, business entity franchising and formations, and business and property transactional issues. He has appeared numerous times before planning commissions and City Councils to protect the rights of property owners and has helped many small and medium-sized businesses with entity formation, including partnerships, corporations, and limited liability companies, and with general legal counseling concerning business and property transactions and employment matters. In his business counseling activities, Eric has substantial expertise and experience in financial and accounting issues and related entities matters, including licensing, franchising, and other forms of joint ownership and control of business organizations.
